Context These proposals will also provide the general frame for those areas not covered by specific harmonised rules but where the functioning of the Internal Market is ensured by mutual recognition, as developed by the European Court of Justice in its “Cassis de Dijon” jurisprudence. Under this principle, in the absence of Community harmonisation, Member States may only restrict the placing on the market of products lawfully marketed in another Member State when and to the extent that this can be justified by a legitimate interest such as the protection of public health and that the measures taken are proportionate.
